1. Acceptance of these Terms
These Terms & Conditions (the “Terms”) form an agreement between you and SalamaWay Trace (“SalamaWay Trace”, “we”, “us”, or “our”) governing your access to and use of the SalamaWay Trace website, application, notifications, and related services (together, the “Service”).
By creating an account, signing in, submitting an item or report, making a claim, or otherwise using the Service, you confirm that you have read and agree to these Terms and our Privacy Policy. If you use the Service for an organisation, you confirm that you have authority to bind that organisation. If you do not agree, do not use the Service.
2. Eligibility and account responsibilities
You must be at least 18 years old and legally capable of entering into this agreement. A person under 18 may use the Service only with the involvement and permission of a parent or legal guardian, who is responsible for that use.
You must provide accurate, current information and keep it updated. You are responsible for activity under your account and for protecting your password, passkeys, devices, and access tokens. Do not share credentials or permit unauthorised access. Tell your administrator promptly if you suspect that your account or passkey has been compromised.
You may use email and password, Google sign-in, or supported passkeys. Some sign-in methods may not be available at all times. You may not create an account using another person’s identity or contact details without authority.
3. How the Service works
The Service lets eligible users:
- record property such as devices, documents, keys, and other valuable items;
- submit lost or found reports with an item type, serial or identifying number, description, image, date, and location;
- receive possible matches generated from report information;
- submit an ownership claim against a possible match; and
- receive in-app or email notices about accounts, matches, and claim outcomes.
Authorised administrators may manage item categories, review reports and claims, approve or reject claims, manage users and departments, configure notifications, and inspect security or activity logs according to their assigned permissions.
4. Item records, reports, and your content
You retain any rights you have in text, images, and other material you submit (“User Content”). You grant us a non-exclusive, worldwide, royalty-free licence to host, copy, process, display, and share User Content only as reasonably needed to operate, secure, improve, and administer the Service, investigate misuse, resolve claims, or comply with law.
You represent that your User Content is accurate to the best of your knowledge, relates to a genuine item or event, and does not infringe another person’s privacy, intellectual-property, or other rights. Do not upload government identity numbers, financial credentials, passwords, intimate images, or other information unnecessary to identify an item. Images are stored on web-accessible media storage; avoid including faces, addresses, documents, or backgrounds that reveal unnecessary personal information.
An item record or report does not register title, prove ownership by itself, create a police report, or replace receipts, serial-number records, insurance documents, or official reporting channels. Keep your own supporting evidence.
5. Matching, claims, and handover
Possible matches are generated using item category and identifiers. An exact normalised serial-number match may receive a high match score; otherwise, the Service may compare descriptive names and show results that meet an internal similarity threshold. A score is only an indicator and can be wrong, incomplete, or manipulated. It is not a finding of legal ownership.
Administrators may review information connected to a claim and approve or reject it. Approval is an operational decision that permits the recovery process to continue; it is not a judicial or legally binding determination of title. We may ask for additional evidence, involve relevant authorities, or decline to facilitate a handover where there is doubt or a safety concern.
When a claim is approved, the finder’s name, email address, and phone number may be disclosed to the claimant so the parties can coordinate. Both parties must use those details only for the approved recovery, must not publish or misuse them, and should choose a safe public location or an authorised collection point. Never pay an unverified fee, send money in advance, or meet alone where doing so feels unsafe. Contact law enforcement if theft, fraud, threats, or dangerous property may be involved.
6. Acceptable use
You must not:
- submit a false report, fraudulent claim, misleading evidence, or content about property you do not legitimately possess or seek;
- use the Service to steal, fence, extort, harass, stalk, impersonate, defraud, or obtain personal information;
- upload malicious code or unlawful, abusive, defamatory, obscene, discriminatory, or rights-infringing content;
- probe, bypass, disrupt, overload, scrape, reverse engineer, or gain unauthorised access to the Service, accounts, permissions, or data;
- circumvent rate limits, security controls, reCAPTCHA, authentication, claim review, or administrator decisions;
- use another user’s contact details for marketing or for any purpose unrelated to an approved claim; or
- use the Service in violation of applicable law or another person’s rights.
We may preserve evidence and report suspected crime, fraud, threats, or abuse to an organisation administrator or competent authority where permitted or required by law.
7. Service communications
You agree that we may send transactional communications reasonably necessary to provide and secure the Service, including welcome messages, match alerts, claim notices, password or security alerts, and administrative communications. Delivery can be delayed or fail, so you should not rely on a notification as the only way to monitor a report or protect property. Any marketing communication will be handled separately and in accordance with applicable law.
8. Third-party services
The Service may rely on third parties such as Google for optional identity sign-in and reCAPTCHA verification, email delivery providers, hosting providers, and device or browser passkey technology. Your use of a third-party feature may also be governed by that provider’s terms and policies. We are not responsible for third-party products or for events outside our reasonable control.
9. Our intellectual property
Except for User Content and third-party material, the Service—including its software, interface, branding, text, graphics, and arrangement—is owned by or licensed to us and protected by applicable law. These Terms give you a limited, revocable, non-exclusive, non-transferable right to use the Service for its intended purpose. No other rights are granted.
10. Availability and disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available”. We do not promise that the Service will always be uninterrupted, secure, error-free, or current, or that a report will produce a match, a match will be accurate, a claim will be approved, an item will be returned, or a returned item will be in its original condition.
We do not verify every user, report, image, serial number, statement, or item. You are responsible for evaluating information and taking sensible precautions. Nothing in these Terms excludes a warranty, remedy, or consumer right that cannot lawfully be excluded.
11. Limitation of liability
To the fullest extent permitted by applicable law, SalamaWay Trace and its officers, personnel, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or for loss of profits, opportunity, goodwill, data, or property arising from or related to the Service, another user, a false or missed match, an unauthorised disclosure, or an item exchange.
Where liability cannot be excluded, it is limited to the amount paid by you specifically for the Service during the twelve months before the event giving rise to the claim, or KES 10,000 if you paid nothing, whichever is greater. This limitation does not apply to fraud, wilful misconduct, gross negligence, or any liability that applicable law does not permit us to limit.
12. Indemnity
To the extent permitted by law, you will indemnify and hold harmless SalamaWay Trace and its personnel from third-party claims, losses, and reasonable costs arising from your User Content, fraudulent or unlawful conduct, misuse of another person’s information, breach of these Terms, or infringement of another person’s rights. This obligation does not apply to the extent a claim was caused by our own unlawful conduct.
13. Suspension and termination
You may stop using the Service at any time. You may request account closure using the contact route below. We may restrict, suspend, or terminate access; remove content; revoke access tokens; or preserve an account where reasonably necessary to address a breach, fraud, a security risk, a legal requirement, or harm to users or the Service. Where appropriate, we will provide notice and an opportunity to respond.
Termination does not erase obligations or records that must reasonably survive, including approved claim records, legal holds, security logs, licences necessary for retained content, disclaimers, liability limits, and dispute provisions.
14. Changes to the Service or Terms
We may update the Service and these Terms. We will post the revised Terms and update the date above. If a change materially affects your rights, we will provide reasonable additional notice through the Service or your registered contact details where practicable. Continuing to use the Service after the effective date means you accept the revised Terms; otherwise, you should stop using it and request account closure.
15. Governing law and disputes
These Terms are governed by the laws of Kenya, without regard to conflict-of-law rules. Before starting formal proceedings, you and we agree to make a good-faith effort for 30 days to resolve a dispute through written notice. Subject to any mandatory consumer right, the courts of competent jurisdiction in Kenya will have jurisdiction.
16. General terms
If a provision is unlawful or unenforceable, it will be limited or removed only to the minimum extent necessary and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our written consent; we may transfer them as part of a merger, reorganisation, sale, or transfer of the Service, subject to applicable law. These Terms and the Privacy Policy are the entire agreement about the Service unless a separate written agreement expressly applies.
